Terms of use
Access to and use of this website grants the status of user, who fully accepts the conditions established herein, the Privacy Policy and the Terms and Conditions of the service.
- Using BabyFlip requires being at least 18 years old or having authorisation from a legal guardian.
- The user agrees to use the site in accordance with the law, good morals, public order and these conditions.
- BabyFlip reserves the right to modify the presentation, configuration and content of the website at any time.
Intellectual property
All content on the website — including brand, logos, design, source code, text, graphics and other elements — is owned by BabyFlip or its respective holders and is protected by current intellectual and industrial property legislation.
The reproduction, distribution, public communication or transformation of any content on this site without prior written authorisation is expressly prohibited.
Users who publish content (photos, product descriptions, etc.) on BabyFlip retain the rights to their creations, but grant BabyFlip a non-exclusive, free and revocable licence to display them on the platform in order to provide the service.
Prohibitions
The use of BabyFlip for the following purposes is expressly prohibited:
- Selling counterfeit, stolen, unsafe products or products that do not comply with child safety regulations (mandatory CE marking) to BabyFlip.
- Carrying out fraudulent, deceptive activities or those that mislead about product characteristics.
- Collecting data from the website without authorisation (scraping, harvesting).
- Impersonating another person or creating fake accounts.
- Using the platform for purposes not legitimate to BabyFlip.
- Carrying out activities that may damage, disable, overload or affect the operation of the platform.
- Interfering with the technical operation of the platform.
Non-compliance may result in the suspension or cancellation of the account, without prejudice to any legal actions that may apply under the Código Penal and other applicable legislation.
Limitation of liability
BabyFlip operates under a C2B2C model: it purchases products from individuals, verifies them, refurbishes them and resells them to the final buyer. BabyFlip is therefore a direct party to transactions and assumes the legal obligations as seller in accordance with Real Decreto Legislativo 1/2007 (TRLGDCU), including legal warranty, right of withdrawal and product conformity.
However, BabyFlip shall not be liable in the following circumstances:
- Original seller information: BabyFlip inspects received products but cannot 100% guarantee the accuracy of information provided by the original seller (usage history, hidden defects not detectable by visual inspection).
- Misuse: Damage resulting from improper use of products by the buyer, contrary to the manufacturer's instructions.
- Service availability: Temporary interruptions of the platform due to maintenance, updates or force majeure.
- Indirect damages: Loss of profit or indirect damages not directly attributable to negligent conduct by BabyFlip.
- External links: Content, policies or practices of third-party websites linked from the platform.
BabyFlip is committed to verifying the condition of each product before putting it up for sale, to acting diligently in response to any claim and to complying with all legal obligations as a professional seller of second-hand products.
Data accuracy
The user warrants that all data provided to BabyFlip is truthful, accurate and complete, and undertakes to keep it up to date by notifying any changes. The user shall be solely liable for any damage or loss, direct or indirect, that may arise from the falsity or inaccuracy of the data provided.

Privacy policy
At BabyFlip, we take the protection of your personal data very seriously. This policy describes how we collect, use and protect your information in accordance with Reglamento (UE) 2016/679 (RGPD), Ley Orgánica 3/2018 (LOPDGDD) and Ley 34/2002, de Servicios de la Sociedad de la Información y del Comercio Electrónico (LSSI-CE).

5. International transfers
Some of our providers may be based outside the European Economic Area (EEA). In those cases, transfers are protected by means of the appropriate safeguards provided for in the RGPD, such as Standard Contractual Clauses approved by the European Commission or the EU-US Data Privacy Framework.

7. Security measures
We implement technical and organisational measures in line with the state of the art to ensure the security, confidentiality and integrity of your personal data, including encryption of communications and stored data, access controls and backups.

10. Subcontracting of services
The user authorises BabyFlip to subcontract with third parties the services of storage, backup custody and data processing when necessary for the provision of the service. In any case, subcontractors shall be subject to the same data protection obligations as BabyFlip and under the same security standards.
11. Automated decisions
BabyFlip may use automated processes for the following purposes:
- Fraud detection: automatic pattern analysis to prevent fraudulent activities.
- Recommendations: product suggestions based on preferences and browsing.
- Content moderation: automatic filters to detect inappropriate content.
In accordance with Article 22 of the RGPD, no automated decision produces significant legal effects without human intervention. You can request human review of any automated decision by contacting privacidad@babyflip.com.
Terms & conditions
1. Introduction
By accessing and using BabyFlip, you accept these terms and conditions in full. If you disagree with any part of these terms, you must not use our service.
BabyFlip is a refurbished baby gear platform. We buy directly from families, refurbish each product and sell it with a warranty. We also offer Baby Lists (baby gift registries). By using our service, you agree to:
- Provide accurate and truthful information
- Maintain the security of your account
- Not engage in fraudulent activities
2. Products and transactions
BabyFlip operates under a C2B2C model: we buy products from individuals, inspect, refurbish and sell them to the final buyer. BabyFlip sets the selling prices. All prices displayed on the platform include applicable taxes.
If you sell to BabyFlip, you agree to:
- Describe the product accurately and truthfully
- Be the legitimate owner of the product
- Comply with applicable safety regulations
3. Privacy and data
We protect your privacy and personal data in accordance with our privacy policy. For more information, please refer to our full privacy policy detailed above.
4. Right of withdrawal
In accordance with Article 102 of Real Decreto Legislativo 1/2007 (TRLGDCU), as a consumer you have the right to withdraw from your purchase within 14 calendar days without giving any reason.
Return conditions
- The period expires 14 days after the material acquisition of the goods.
- To exercise this right, you must notify us of your decision through an unambiguous statement (for example, an email to soporte@babyflip.com).
- Products must be returned in their original condition with their packaging. Any alteration of the product may result in the return being rejected and may entail additional costs.
- If the product is defective or does not match the description, BabyFlip assumes the return costs.
- In the case of voluntary withdrawal without defect, the direct costs of the return shall be borne by you.
For exceptions to the right of withdrawal, please refer to Article 103 of the TRLGDCU.
5. Legal warranty
All refurbished products sold by BabyFlip are covered by a legal warranty of 12 months from the date of delivery, in accordance with Article 120.1 of Real Decreto Legislativo 1/2007 (TRLGDCU), which allows the warranty to be reduced to one year for second-hand goods sold by businesses. By making a purchase on BabyFlip, the user expressly accepts this warranty period.
What does it cover?
The warranty covers any lack of conformity that existed in the product at the time of delivery. If you detect a problem, contact us at soporte@babyflip.com.
6. Online dispute resolution (ODR)
In accordance with Art. 14.1 of Reglamento (UE) 524/2013, the European Commission provides a free-access online dispute resolution platform, available at the following link:

We reserve the right to modify these terms at any time. Changes will take effect immediately after publication on the site. We will notify you of substantial changes by email or a prominent notice on the platform.
8. Jurisdiction and applicable law
These conditions are governed by Spanish law. For the resolution of any dispute arising from access to or use of the service, the parties submit to the Courts and Tribunals of the user's domicile, in accordance with current consumer protection legislation.
If the user acts as a business or professional, both parties submit, with express waiver of any other jurisdiction, to the Courts and Tribunals of the city where BabyFlip has its registered office.
Sale conditions
1. Who are we?
BabyFlip buys second-hand baby gear from individuals, professionally refurbishes it and sells it to the final buyer. Unlike a traditional marketplace, BabyFlip acts as a direct buyer of your products.

2. Who can sell to BabyFlip?
To sell products to BabyFlip, you must meet the following requirements:
- Be at least 18 years old. Minors cannot make sales.
- Be the legitimate owner of the product you wish to sell.
- Reside in Spain (we currently operate in mainland Spain only).
- Have a Spanish bank account (IBAN ES) to receive payment.
3. What products can you sell?
BabyFlip buys second-hand baby and childcare products in good condition. Eligible products include:
- Pushchairs and strollers
- Cots and bassinets
- Car seats (groups 0, 0+, 1, 2, 3)
- High chairs and bouncers
- Baby carriers and backpacks
- Baby baths and changing tables
- Playpens and travel cots
- Specialised toys and stimulation products
- ...
3.1 Products not accepted
We do not accept products that:
- Are basic toys or clothing.
- Are more than 3 years old
- Are broken, rusted or have irreparable damage of any kind (structural, textile, etc.)
- Do not comply with current European safety regulations
- Have been subject to a manufacturer recall
- Are counterfeits or imitations
- Contain hazardous substances (lead paint, etc.)
- Car seats that have been involved in an accident
4. How does the sale process work?
4.1 Initial offer
When you complete the sale form with information and photos of your product, our system will present you with an initial offer. This offer is based on a number of variables, such as:
- The product category and brand
- The actual condition of the product
- Current market prices
- The indicated availability
This initial offer is not binding until BabyFlip inspects the product and confirms that the declared conditions match the actual ones.
4.2 Accepting the offer
If you decide to accept the initial offer, you will need to:
- Provide your personal details (name, date of birth, address)
- Provide your IBAN to receive payment
- Accept these Sale Conditions
- Coordinate the collection or shipment of the product
4.3 Collection and inspection
Once logistics are coordinated:
- A courier will collect the product from your home at no cost to you
- You will receive a prepaid shipping label
- BabyFlip will inspect the product upon receipt
4.4 Possible second offer (re-offer)
If during inspection we detect discrepancies between the declared and actual condition:
- We will send you a second offer with the new adjusted price
- You will have 7 days to accept or reject this second offer
- If you reject it, we will return the product to you. Return costs will be borne by you
- If you do not respond within 7 days, it will be considered automatically accepted
4.5 Payment
Once the offer (initial or re-offer) is accepted:
- Payment will be made by bank transfer within approximately 7 business days from product collection (including transport, inspection and processing)
- Identity verification (DNI/NIE) is mandatory to receive a payment
5. Transfer of ownership
By accepting the offer and sending the product:
- You declare that you are the legitimate owner of the product and that you have full right to sell it.
- You transfer to BabyFlip full ownership of the product once payment is made.
- You waive any right, title or interest in the product from the date of payment.
6. Your obligations as a seller
By selling to BabyFlip you agree to:
- Provide truthful and accurate information about the product's condition
- Include real and current photographs of the product
- Clean the product before shipping
- Protect the product with basic packaging for transport (professional packaging is not necessary)
- Include all original accessories mentioned in the description
- Prepare the product within a maximum of 7 days after accepting the offer
7. Invoicing
7.1 Individuals
If you sell as a private individual (occasional sale of your own goods), BabyFlip will issue a self-invoice on your behalf, which you can download from your user dashboard.
7.2 Self-employed and businesses
If you sell as a self-employed person or business, you must issue an invoice to BabyFlip with the tax details that we will provide.
7.3 Applicable tax regime
Acquisitions from private individuals fall under the Special Scheme for Second-Hand Goods (REBU), as regulated by Articles 135 to 139 of Spanish Law 37/1992 on Value Added Tax (LIVA). Under this scheme, VAT applies solely to BabyFlip's commercial margin and is not itemised on invoices issued to the final buyer. All published prices include applicable taxes.
8. Data protection
We process your personal data in accordance with the RGPD (EU) 2016/679. For more information, please refer to our Privacy Policy.
Bank details (IBAN) are stored encrypted and are only used to make the corresponding payment.
9. Cancellation
You can cancel the sale at any time before sending the product. Once sent, you can only cancel if you reject a second offer (re-offer).
10. Limitation of liability
BabyFlip shall not be liable for:
- Damage caused by false or inaccurate information provided by the seller
- Loss during transport if packaging was inadequate
- Banking delays in receiving payment
11. Dispute resolution
In case of disagreement, we will try to resolve it amicably. If this is not possible, you may resort to:
- EU Online Dispute Resolution Platform
- Your local Oficina Municipal de Información al Consumidor (OMIC)
These conditions are governed by Spanish law. For any dispute, the courts of your domicile shall have jurisdiction.
12. Modifications
BabyFlip may modify these conditions at any time. Modifications will not affect sales already accepted. We will notify you of changes by email if you have an active account.
